Difference Between Divorce and Dissolution

Divorce and dissolution seem similar in concept and meaning, but they are not similar. They do show some differences between them when it comes to the legal application.

Divorce is granted by the court on the basis of findings of misconduct by a party or the other. On the other hand the dissolution is a divorce which is not based on misconduct or faults of any the parties. That is, the dissolution is not granted by the court on the basis of findings of misconduct by any of the parties. This is the main difference between dissolution and divorce.

Basis for divorce are different. Many factors may be cited as the factors that initiated divorce. These factors include adultery, imprisonment, excessive cruelty and alienation of affection. On the other hand, when differences of opinion continue to exist between the couple and continuation of marriage becomes impossible and then the couple may opt for the dissolution.

It is important to note that the effects of both these means of separation are quite similar in many ways. When the court passes the order in support of divorce or dissolution, it is true that court gives judgment on all matters relating to marriage like alimony, child custody, the child support and marital property as well.

It is important to understand that in both the cases the couple is separated.  Divorce and dissolution have same purpose but different in concept and procedure. In fact, couples who want to end their marriages can go for divorce or dissolution according to their own understanding of the circumstances and consequences.

In short we can say that if couple wants to get separated without blaming each other then they can opt for the dissolution procedure. Filing off application for dissolution does not allow filing it on the basis of any fault and if any of the parties wish to do so then they must go for divorce and not dissolution.

It is generally believed that divorce and dissolution are different in terms of the expenses involved, too. In fact the expenses involved in divorce are higher when compared to the expenses involved in the dissolution. This is due to the fact that the dissolution is only available when couples request the same relief from the court.
